Terms of Service for Triad PC Repair of Lexington

Introduction

Welcome to the services provided by Triad PC Repair of Lexington Inc. ("Company", "we", "us", "our"). By using our services, you agree to these Terms of Service ("Terms").

Acceptance of Terms

By using our services or purchasing our products, you confirm that you accept these Terms and agree to be bound by them. If you do not agree to these Terms, please do not use our services or purchase our products.

Changes to the Terms

We reserve the right to modify these Terms at any time. Your continued use of our services or products following any changes signifies your acceptance of the updated Terms.

Description of Services and Products

We offer computer repair services, Managed Service Provider (MSP) services to our business clients, and a Monthly Service Subscription covering antivirus, windows update management, and help desk support. We also sell new and refurbished computers.

User Responsibilities

  • Data Backup: It is your responsibility to back up all software and data stored on your computer's hard disk drive(s) and/or on any other storage devices you may have prior to receiving any service from us.
  • Software Licenses: You agree to provide legal copies of all software to be installed or reinstalled.

Monthly Service Subscription

  • Subscription Period: Your subscription will start on the date that your payment is received and will continue for a period of one month. Subscriptions automatically renew unless canceled.
  • Payment: Payment for monthly services is due at the beginning of each service month. Late fees may apply.
  • Services Covered: Depending on ther service level, the monthly subscription may include; antivirus solutions, windows update management, and access to our help desk.
  • Service Limitations: We do not guarantee that our antivirus will catch every virus or that update management will prevent all software issues.
  • Cancellation Policy: Subscriptions can be canceled with 10 days notice before the next billing cycle. No refunds will be provided for partial months.
  • Changes to Services: We reserve the right to modify the services provided under the subscription at any time, with prior notice.

Product Warranties and Returns

  • New Computers: New computers come with a 1-year hardware warranty.
  • Refurbished Computers: Refurbished computers come with a 1-year hardware warranty.
  • Return Policy: Products may be returned within 14 Days of purchase, subject to our Return Conditions.

Return Conditions

  • Original Packaging: Items must be returned in the original packaging, including all accessories, manuals, and documentation.
  • Time Frame: Returns are accepted within 14 days from the date of purchase.
  • Restocking Fee: A restocking fee (e.g., 15% of the item's price) may apply for opened or used products.
  • Receipt Required: A valid purchase receipt must accompany the return.
  • Condition: Items must be in "like-new" condition or as purchased condition for refurbished items, without any signs of physical damage, wear, or alteration.
  • Software: Any software that comes pre-installed must not be tampered with, and activation/product keys must not be redeemed.
  • Data: It is the customer's responsibility to remove all personal data from the device before returning it. Triad PC Repair of Lexington Inc. is not responsible for any data loss or data breaches that occur from returned items.
  • Exceptions: Clearance items, custom-built computers, and special orders may not be returnable or may have different return conditions.
  • Shipping: Customers are responsible for shipping costs for returning the item unless the product is faulty or there was an error on the part of Triad PC Repair of Lexington Inc.
  • Refunds: Refunds will be issued in the same form of payment used for the original transaction.
  • Warranty Claims: Items under warranty that are found to be defective may be repaired, replaced, or refunded at the discretion of Triad PC Repair of Lexington Inc.
  • Dispute Resolution: Any disputes arising out of returns will be resolved in accordance with the laws of the State of North Carolina.

Payment

Payment is due upon completion of services or at the time of product purchase unless otherwise agreed upon. We accept cash, checks, Visa, and Amex card payments.

Limitation of Liability

To the extent permitted by law, we will not be responsible for any damage or loss of data, software, or hardware that may occur during or as a result of our services or products.

Termination

We reserve the right to terminate or suspend service and/or product warranties at our discretion if you violate these Terms or any other policies we may have in place.

Governing Law

These Terms are governed by the laws of the State of North Carolina.
